U.S. Customs & Border Protection (CBP) recently announced that is has collected nearly $22 billion in tariffs levied on steel and aluminum under Section 232 and on certain goods of China under Section 301.  Both tariff measures have procedures to request exclusions, although the process and remedy under the two tariff measures is markedly different. While the deadline to request exclusions under Section 301 has expired, exclusions for steel and aluminum can be filed any time and the Commerce Department continues to process these.  Notably, for the steel tariff, the Commerce Department has only approved roughly 9% of applications in cases where domestic interests have filed objections. 


This webinar will review the current status of exclusions under Sections 232 and 301, the process for submitting exclusion requests under Section 232, the procedures for obtaining duty refunds when exclusions are granted, and strategies for challenging the denial of exclusions and obtaining retroactive tariff relief.
